Contested contact dispute

Private Law (Child Arrangements Programme (CAP))

28 November 2023

Clive represented a Mother who sought to oppose the Father’s application to have staying contact with his son in a European country in which he was resident. The case involved a number of safeguarding issues including past domestic abuse, failure to seek proper medical treatment for the child and the use of illegal drugs.

Clive advised his client in the preparation of her evidence and in respect of familiarising her with the whole court process in order to reduce the stress of the experience as much as possible. The matter went to a final hearing, where Clive was able to persuade the court that contact should take place in this country and not abroad, and that the child’s contact with the Father should not include any overnight visits.
