Opposing a relocation

Sophie was recently instructed by a Father in internal-relocation proceedings.

The Mother of the children hoped to move away from the local area and relocate with her children several hours’ journey away, with a view to being closer to the maternal side of the family and her new partner. This proposed move was opposed by Sophie’s client on the basis that it would drastically reduce his time and involvement with his children.

Sophie worked closely with her instructing solicitors throughout proceedings, and not only offered advice at each step of the way but was also involved with the preparation of key documents such as a statement of law specifically addressing recent relocation cases. Through such work, Sophie was able to demonstrate a high level of knowledge of relocation cases and the legal considerations the Court should be adopting as part of their decision.

During a lengthy final hearing, Sophie successfully opposed the Mother’s proposed move, and obtained a prohibitive steps order preventing her from relocating or removing the children from their current school. In addition, she secured a final order that provided the Father with a high level of regular contact with the children.
