Lavinia was instructed to represent the Defendant at the hearing to assess quantum of damages for a personal injury, sustained in a Road Traffic Accident. The injury was a relatively minor whiplash injury to the neck with duration of 12 months. The Claimants had valued the injury at £3,900. Lavinia made successful submissions that this valuation took insufficient account to the other factors that should be viewed when assessing an injury. Lavinia reminded the District Judge of the opening remarks in the JCG 14th Edition, that a focus on duration alone takes insufficient account of other factors.
Lavinia was successful in persuading the District Judge that, in light of the unremarkable impact this injury had on the Claimant’s life, an appropriate award should be £2,600.
