Acting for a local authority in counterclaim of unlawful eviction

Paul acted for the Local Authority in connection with a possession claim where a tenant was believed to have vacated the property which involved a counterclaim for unlawful eviction, trespass to goods (the counterclaim being valued in the region of £300,000) and animal cruelty (the local authority’s alleged failure to care for the tenant’s goldfish).

The counterclaim was dismissed, with the Defendant being ordered to pay the Authority’s legal costs, secured against a property the tenant had purchased just before they had vacated the council accommodation.
