Application to permanently remove their child from the jurisdiction

Marie represented a father in an application made by the mother to permanently remove their child from the jurisdiction. The father made a cross application for shared care order and to spend increased time with the child. The final hearing took 6 days, with a number of witnesses on both sides and the Cafcass officer.

The father was successful, the court refused the mother’s application and made a shared care order for the child to spend alternate weeks with each parent and for school holidays to be shared equally save that if the mother returns to her home country with the child she would have 4 weeks of the summer holidays, if not that holiday would also be shared equally.
