Defending a claim for adverse possession

Holly successfully defended a claim for adverse possession in respect of a field in Kent, appearing at:

  • injunction proceedings in the county court
  • a two-day trial in the Lands Tribunal.

The elderly owner of the field wished to sell the land. The claimant contended that he had used the land for 20 years, however Holly’s client was adamant that he had not, and successfully obtained an injunction to prevent him from accessing her land pending a final determination of the matter.

Holly’s representation included presenting evidence from several parties who were able to support her client’s ownership of the land, including the individual who had sold it to her 30 years previously, and involved a site visit by the Court. Holly was successful in retaining the field on her client’s behalf, as well as her costs being awarded in full.
