Defending against claim for negligence
Lavinia represented the Defendant, a driver for a supermarket chain, against a claim of negligence resulting in a road traffic accident. The Claimant’s vehicle had been hit by the Defendant’s at traffic lights.
She argued that any negligence was on the part of the Claimant, who had failed to make the Defendant aware of his vehicle’s presence or allowed sufficient room for manoeuvre. The Court agreed with her and found that it was an unfortunate accident but that the Defendant was not negligent.
