Enabling a mother to retain care of her children

Ronald represented a mother of four children in care proceedings. At the first hearing, the matter was listed for immediate removal of the children from the mother’s care and this application was supported by the guardian for the children.

Ronald was able to persuade the court that the mother should be allowed the opportunity to put in a statement setting out her opposition to the Local Authority’s application. The mother’s argument was on the basis that the children had been in her care for the last year and there was nothing to trigger the urgency of the application on the day. As a result, at the contested hearing a few weeks later only one of the four children was removed from the mother’s care.
