Keeping a child in extended family care

Kevin represented the mother and maternal grandmother in proceedings where there were allegations of domestic violence and alcohol abuse against both parents, who had separated.

The allegations were proven against both parents and the judge ruled that the child could not be placed in the care of either of them. The Local Authority wanted to place the child in care. However, Kevin successfully argued that the child should be placed with the maternal grandmother.

This case demonstrated Kevin’s ability to:

  • effectively resist an application for the interim removal of the child
  • give the mother objective advice as to the most realistic outcome for her
  • advise on evidence so as to present a strong case for placement within the extended family.
