Order to enable man to collect belongings despite non-molestation order

Marie represented a client who had left his partner (with whom he has no children). She had made allegations of violence against him (which he strongly denied), and obtained an ex parte non-molestation order against him.

At the return date, she did not attend, and orders were made to allow him to return to the property for the sole purpose of collecting his belongings.

The case was listed for a further hearing, however, if all is agreed by consent in the meantime, and he is able to get his belongings back without any difficulty, it is likely that a consent order could be sent into the Court in relation to the non-molestation order.
