Parental contact involving assault

Corey acted for the mother of two children on an application by father for contact, where the father was awaiting trial in concurrent criminal proceedings for alleged serious assault against Corey’s client.

With Corey’s assistance, his client opposed contact on the basis of the father’s violence. A fact-finding hearing was held to determine whether the father had carried out acts of violence against the mother. Domestic violence was found as a fact by the Court, which informed a risk assessment report on the father, who was only allowed supervised contact.

Corey was able to give sensitive support and calm advice to a vulnerable client, enabling her to understand the options available, engage in the court process and make the most appropriate decisions for her and the children.
