Protecting the interests of residents in an urban Conservation area

Planning

28 November 2023

Melanie represented the Respondent at a planning enquiry involving an appeal against a refusal of planning permission for a development in an urban Conservation Area.

The proposed development would have involved the demolition of a substantial family home and the construction of a large block of flats. The new-build having a larger footprint, as well as being substantially higher than the existing property, had aroused significant local objection – complaints centred on loss of privacy as well as reduction in value of surrounding properties. The case presented on behalf of the Respondents was successful and the refusal against planning permission was upheld by the Planning Inspector.
