Reducing a husband’s payments to a manageable level

Holly represented a client who was seeking to reduce the periodical payments that he made to his former wife. He had agreed a generous provision some years earlier but was now struggling to maintain the payments. Also, changes in the circumstances of the wife, including a move away from the former family home, brought about his application for a staged reduction to nominal payments and remittance of the arrears.

Holly assisted her client at both hearings and prepared a detailed schedule and skeleton argument. The Court heard evidence and submissions from both parties.

Holly’s attention to detail helped to ensure that the Court granted the client’s application, immediately reducing his payments by over 40%, and further ordering that they reduce to become nominal after 1 year. All arrears were remitted and no costs order was made.
