In finding for the claimant, the Judge found that Melanie had established that on the balance of probabilities proper safeguards had not been in place to ensure the safety of workers, that there had been a fundamental breach of the Workplace (Health, Safety and Welfare) Regulations 1992, and that risk assessments prepared by the employer had not in practice been adopted in the day to day management of the workplace.
