Sandria acted for a Mother in a contact application by the Father. The Mother had made allegations of domestic violence (both verbal and physical), and the Father was under police investigation.
The matter was listed for Fact Finding, however it was ruled that a decision by the Judge was not appropriate, as previous findings by the Judge stand, and the police investigation was unresolved.
A s. 7 Report was required as matter of urgency to resolve issue of whether, if any, contact with the Father was in the child’s best interests, and if so how it should be managed. The Prohibited Steps order was to remain in place –with the question of possible abduction being live, and there were cultural issues in relation to perceived threats to the Mother.
