Representing a Mother protecting a child from sexual abuse by Father

Marie represented a Mother in a case where the child had alleged sexual abuse by the Father. The matter had been dealt with by the Police and Children’s Services. The Father then made an application to spend time with the child and Marie was instructed to represent her client. A Children’s Guardian was appointed under rule 16.4.

A fact-finding hearing to determine the allegations was held, and the allegations that he had sexually abused the child were found proved. The next step would have been a sexual risk assessment of the Father by experts, however, he withdrew his application after the fact-finding judgment and the case concluded with no contact between the child and the Father.
