Successful application for the grant of a Certificate of Lawful Development

Paul was instructed in a case involving an ‘overage agreement’ requiring payment by the purchaser of a property in the event of any subsequent development of the site within 20 years.

The property was extended and was the subject of a successful application, (outside the twenty year period) for the grant of a Certificate of Lawful Development in respect of an Agricultural Occupation Condition.

Negotiations are continuing.
