Obtaining an order securing a child in the father’s care

Holly represented a Father who sought an order securing his child in his care. The young child had previously lived with the Mother, but ongoing concerns about the violent relationships that she was in meant that the Father took over the child’s care. The Mother now sought the return of the child to her care.

A section 7 report from Social Services supported the child remaining with the Father, and a final hearing took place, involving Holly’s expertise at cross-examining witnesses, at which the social worker’s justification was tested and both parents gave evidence.

The court ordered that the child should live with the Father, and spend time with the Mother for the periods that the Father proposed.
