Marie represented the Mother of three young children in a case where, for some time since separation, the Father’s behaviour at contact handovers had got progressively worse. She had already called the police on a number of occasions as a result of his aggressive behaviour, and this culminated in physical assault after which she needed medical treatment.
Marie successfully applied for a non-molestation order, and the handovers of contact were changed to a public place with CCTV. This means that, should there be any further incidents, the Mother can call the police and any breaches will be criminal offences. The arrangements for contact were reduced, and the Mother also applied for a variation to the Child Arrangements Order in place.
The Father disputed the issue of his aggressive behaviour, so there will be a contested hearing which will also be the fact finding for the Mother’s application to vary child arrangements.
