Case Summary

This was a simple credit hire case where the argument was over the rate to be used.  The Defendant had put forward a range of basic hire rates of which the cheapest was at Gatwick Airport some 35 miles from the Claimant’s home.  I submitted that the airport rate was neither a suitable local rate (as it was geographically out of the area) nor was it a suitable national rate as airport rates were known to have to compete with multiple other companies in a single location.

Result

The court took a basic rate which was higher than that suggested by the Defendant, but lower than the Credit Hire rate
