Returning a child to a Father after extreme alienation

Children – Public Law

29 November 2023

Marie acted for a Father who had not seen his child for two years because the Mother repeatedly breached Court Orders. In an extreme case of alienation, she had even told the child that the Father had died.

The Local Authority commenced care proceedings in respect of this child and two others (not the children of Marie’s client). At this point the child was living with the paternal aunt and uncle, and assessments have now started with a view to the Father resuming care of the child with the Mother having only supervised contact.

With Marie’s support, her client was able to put forward a successful case, and as a result the Local Authority Care Plan is for the child to be placed permanently with the Father.
