Acting for a Father in case involving Jurisdiction

Marie represented the Father in his application to spend time with his child. He is a foreign national with leave to remain in the UK, and the Mother is non-domiciled, with properties around the world. The Father has not seen the child for several months, as the Mother is refusing contact.

The child resided in the UK with the Mother, who sought to challenge the jurisdiction of the Court to make orders as a result of there being an existing family court order from another jurisdiction.

The case was transferred from a District Judge to a Circuit Judge and listed for the issue of Jurisdiction to be determined. Interim contact at a contact centre was also agreed and the Mother gave an undertaking not to remove the child from the jurisdiction pending further determination by the Court.
