Advising a family on intestacy rules
John acted in an advisory capacity to a large family seeking to claim against the estate of the deceased.
Although a Will had been drafted, it had not been properly executed, and was therefore not valid. The beneficiaries sought to rely on the intestacy rules to claim the entirety of the deceased’s estate.
This case, where it was necessary to argue against the rules of intestacy, required John to explain to the family the overlap between a number of very complicated areas of law, including tactics, procedure, and prospects of success. The matter is ongoing.
