Holly Coates represents a Father in Children’s Proceedings

Holly was involved in a case in which the father sought a child arrangements order, which the mother opposed.  The mother alleged that she had suffered serious domestic abuse at the hands of the father.  During the proceedings, cross-applications were made for disclosure of the case papers to the Crown Prosecution Service, to form part of the criminal proceedings brought against the father, as well as to the Home Office in support of the father’s immigration application.

Holly drafted a detailed Note setting out the procedure and law relating to each application.  In the event the father’s application for the release of papers to the Home Office was not pursued, on the basis that it was premature (prior to any findings of fact or final order being made).  The judge was persuaded to allow the release of papers to the Crown Prosecution Service, as supported by Holly’s client.
