Representing a Mother in proceedings around non-accidental injury

Michael acted for the Mother in a case where there were several young children and a new baby due. Both parents have learning difficulties.

The Local Authority had a history of concerns over neglect and the parents’ ability to cope with the needs of the children. These proceedings were issued following a fracture to the youngest child’s ankle, which was considered to be unusual and potentially non accidental.

Michael supported his client through an initial hearing. The parents are on police bail with a condition not to have any unsupervised contact with any of the children. Both parents were considered to be in need of cognitive and capacity assessments and assessment for an intermediary.

Interim care orders were made following EPOs, and ongoing proceedings are listed for CMH.
