Supporting a Mother in contact application, where there is a risk of domestic violence

Sandria represented the Mother in a contact application by the Father. Her client had made allegations of verbal and physical domestic violence by the Father, who was under police investigation. A prohibited steps order was in place, as there was the possibility of abduction, and there were cultural issues in relation to perceived threats to the Mother.

Matter listed as Fact Finding, but in the hearing it was ruled that a decision by the Judge was not appropriate at that time, as previous findings by the Judge stand, and the police investigation was unresolved.

A s. 7 Report was required as matter of urgency to resolve the issue of whether any contact with the Father was in the child’s best interests, and if so how contact should be managed. The prohibited steps order was to remain in place.
