Holly represented a mother in the father’s application for contact with the parties’ two children. The father had not seen the eldest child for some years and had never met the youngest. The mother objected to contact on the basis that the father had subjected her to severe domestic violence during the relationship.
The matter was listed for a fact finding hearing. As the mother was vulnerable and anxious about giving evidence, Holly was able to secure special measures to allow her to give effective evidence in the presence of the father. Holly’s ability to reassure and support her client during the proceedings was vital, particularly since the father represented himself.
After a two day hearing the court made findings that the father had perpetrated all of the violence alleged by the mother.
The court has ordered that the father shall not have direct contact with the children until he has addressed his historic behaviour.
