Returning children to family under strict supervision order

Children – Public Law

28 November 2023

Ronald represented a Father in care proceedings where the Social Workers involved had described the case as, in their professional experience, the worst example of neglect that they had seen.

The Local Authority’s position was bolstered by the parenting assessment of the Father and his partner by an independent social worker, who confirmed the Local Authority’s concerns. The Social Worker added that, if the children were to be returned to their care, the parents would need a level of support that would significantly impinge upon their family life.

The Local Authority’s preferred care plan was for the children to move to another County and be cared for by relatives under Special Guardianship Orders.

After a 12-day hearing, the Court ordered that the children should be returned to the parents’ care, but under the strictest of supervision orders.
