Enforcement of child arrangements order

Private Law (Child Arrangements Programme (CAP))

29 November 2023

Cara acted for the Applicant in an application was for enforcement of a child arrangements order.

The first hearing had been used as a FHDRA and the previous child arrangements order discharged. The Section 7 report had been received for this hearing which suggested a change of residence to the Applicant and for the Respondent to spent time with the children. The Respondent had stopped all contact with the Applicant.

Directions were set for a final contested hearing in respect of two of the children changing residence. It was agreed between the parties that one of the children would go to reside with the Applicant and the Respondent would have contact with that child and allow the Applicant contact with the others.
